These Terms of Service ("Terms") govern your access to and use of the websites whatsup208.com and treasurevalleyinsider.com, our email newsletters, our events and booth activations, and any related products or services we offer (collectively, the "Services") provided by [Publisher Legal Name] ("we," "us," "our").
By accessing or using any of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to use the Services or to subscribe to our newsletters. If you're using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Accounts and access
Most Services don't require an account. Sponsors and admin staff may have accounts. You're responsible for maintaining the security of any account you create, and for all activity under it.
3. Acceptable use
You agree not to:
- Use the Services for any illegal purpose
- Interfere with the Services' operation or security
- Attempt to access data not intended for you
- Reverse-engineer or scrape the Services beyond reasonable use of public APIs we make available
- Submit false, misleading, or harmful content through any of our forms
- Impersonate any person or entity
- Use the Services to harass, threaten, or harm anyone
4. Email subscriptions
By subscribing to our email newsletters, you agree to receive periodic emails from us. You can unsubscribe at any time using the link in any email or by contacting us at brayden@whatsup208.com. We honor unsubscribe requests promptly and per applicable law (CAN-SPAM and state law).
5. Sponsor terms
If you sponsor or advertise with us, you'll sign a separate Sponsorship Agreement that governs that relationship. These Terms apply to your general use of the Services in addition to that agreement. If they conflict, the Sponsorship Agreement controls for sponsorship matters.
6. User-submitted content
When you submit content through our forms — including business recommendations, event suggestions, comments, and feedback — you grant us a non-exclusive, worldwide, royalty-free license to use, modify, publish, and display that content in connection with the Services. You retain ownership of what you submit; we only get the right to use it.
You represent that:
- You own or have permission to submit the content
- The content doesn't infringe anyone else's rights (copyright, trademark, privacy, publicity, etc.)
- The content is accurate and not misleading
- The content doesn't violate any applicable law
We may remove content at our discretion. We don't have an obligation to host or maintain submitted content indefinitely.
7. Intellectual property
The Services — including but not limited to text, design, graphics, logos, the curated event listings, the business directory, the brand names "What's Up 208" and "Treasure Valley Insider," and the underlying software — are owned by us and protected by copyright, trademark, and other laws.
You may use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our express written permission. Sharing individual event listings via social media or word-of-mouth is fine and encouraged.
If you believe content on the Services infringes your rights, contact us at brayden@whatsup208.com with sufficient information for us to investigate.
8. Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
In particular, we do not guarantee that:
- Event listings are always accurate, current, or complete
- Featured businesses meet any particular standard or quality
- The Services will be uninterrupted or error-free
- Any specific result will follow from your use of the Services
You use the Services at your own risk. Confirm event details directly with the host before relying on them.
9. Limit of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
These limits apply regardless of the legal theory.
10. Termination
We may suspend or terminate access to the Services at any time, with or without cause, with or without notice. You may stop using the Services at any time by ceasing access and unsubscribing from emails.
Upon termination, the provisions of these Terms that should survive (intellectual property, disclaimers, liability limits, governing law) will survive.
11. Governing law and disputes
These Terms are governed by the laws of the State of Idaho, without regard to conflicts-of-law principles. Any dispute arising out of or related to the Services or these Terms will be resolved in the state or federal courts located in Ada County, Idaho, and you consent to personal jurisdiction in those courts.
You and we agree to attempt to resolve any dispute through good-faith informal negotiation for thirty (30) days before filing suit.
12. Changes to these Terms
We may update these Terms periodically. We'll change the "Last updated" date and notify you of significant changes by email or a banner on the site. Your continued use of the Services after changes take effect indicates acceptance.
13. Indemnification

- Assignment. You may not transfer your rights under these Terms. We may transfer ours in connection with a sale of the business.
